摘　　要： 国际法主要是国家之间的法律,其地位与作用依赖于各个主权国家的自觉遵守。伊拉克战争和美军虐俘事件对国际法造成重大的冲击和破坏,说明国际法被普遍遵守的前提是大国尊重国际法并且自愿遵守,否则国际法对大国、强国几乎无拘束力。但是,每个国家(包括美国)都必须在与他国的交往中生存与发展,这就为国际法的生存、发展和作用的发挥提供了巨大的空间。怀疑国际法存在的价值或者把国际法的作用无限夸大甚至等同于国内法的作用的观点都是错误的。 International Law is the law between countries, and its position and function is to be complied by sovereign states. Iraq war and prisoner abuse incidents is of vital impact and damage to international law. It demonstrates that the premise of general adherence to international law is big and powerful countries＇ voluntary obedience; otherwise no binding force may be exerted on them. But each individual country （America included） survives and develops to a large degree through the communication with other countries, which, therefore, will provide spatial room for the survival, progress and the scope of function of international law. It is incorrect to doubt the existence or exaggerate the function of international law, or even regard it as domestic law.
