摘　　要： 侵犯著作权的抗辩事由对著作权侵权纠纷的双方利益影响重大。本文从三个角度对侵犯著作权的抗辩事由进行了总结和分析:一、著作权法上的法定抗辩事由;二、民法上一般抗辩事由在著作权法上的适用;三、实践中被告常用的几种抗辩事由辨析。 The demur incidents to infringe the copyright are important for both sides of the entanglemant of infringing the copyright. The text summarize and analysis the demur incidents of infringing the copyright from three aspects： 1. The legal demur incidents in Copyright law; 2. The general demur incidents of civil law apply in the Copyright law; 3. Analysis to a few demur incidents which were used by appellee in practice. It wishes there will be some guidanced significance to theory and practice of the copyright.
