摘　　要： 我国立法没有规定抄袭的认定标准,这导致司法实践中缺乏具体、统一的操作标准,不利于保护著作权人的权益。理论界将抄袭分为四种抄袭类型:一是对原作品毫无改动的抄袭。二是对原作品有所改动的抄袭。三是自己对自己作品抄袭。四是无意识的抄袭。其中主要对前二者的认定标准进行了具体的论述,希望对立法、学术研究及实践有所裨益。 There are no standards about plagiary in our lawmaking, which cause no concrete operation standards in practice of judicatory . It goes against protecting the right of copyrighter . The text distinguish four types of plagiary : 1. no-change plagiary with the original work . 2. part -change plagiary with the original work . 3. plagiary with ones own work. 4. unconscious plagiary . This paper Particularly discusses about the cognizance standards with the front two conditions. wishing that it has some advance to lawmaking, scientific study and practice .
