摘　　要： 国际环境法的环境伦理学依据问题在学术界一直有所争论,概括起来,主要是人类中心主义和非人类中心主义之间的长期论战,这给国际环境法的进一步发展造成了理论上的困惑。澄清这个问题,并进一步确证出国际环境法的环境伦理学依据及其伦理基础是很有理论和现实必要性的。国际环境法的产生和发展是建立在"超越的环境伦理观"这个理论逻辑之上的。作为深具广泛共识性的可持续发展伦理正是"超越的环境伦理观"的最完美的体现,构成了国际环境法产生和发展的逻辑起点和逻辑基础。 It has been debated in the academic circles about the environmental ethics basis of the international environmental law. To sum up, the long-term debate mainly has remained between Anthropocentrism and non - Anthropocentrism. This adds the theoretical confusion to the further development of international environmental law. It is very theoretically and practically indispensable to clarify this issue, and further confirm the environmental ethics foundation and its ethical basis of international environmental law. The emergence and development of international environmental law is based on the theory of environmental ethics of ＂transcendence＂ . As the most perfect embodiment of the environmental ethics of ＂transcendence＂ , the sustainable development ethical rule, which is a deep and broad consensus, constitutes the logical starting point and the logical basis of the emergence and development of the international environmental law.
