摘　　要： 任何类型的法律都有与其相匹配的伦理根基。正处于历史转型时期的当代中国,反思伦理传统是法治中国建设的一个重要环节。家族伦理、等级伦理、神人伦理和和合伦理构成了传统伦理的几个比较稳定而且相互关联的基本特征,它们共同确定了与之相匹配的法律类型。对传统中国伦理与法律关系的梳理、甄别,对当代法律的走向具有很好的借鉴意义,同时也是我们思考软法问题的一个切入点。 Every type of law has its own ethical foundation. We must reflect on the ethical tradition in the process of construction of rule of law during social transition period. Family ethics, hierarchical ethics, god-man ethics, and harmonious ethics constitute the stable and interrelated characteristics of traditional ethics. The importance of analyzing relationship of traditional ethics and law is great to choose the path of legal development of contemporacy and compehend the soft law.
