摘 要: 法律的工具性、世俗性决定了法学教育的实践性导向。但困于理念误区、教学成本、学生规模、教师评价机制、课程体系设置的强制性及与司法考试的疏离等因素,实践性法学课程在整个法学教学体系中实际上处于若存若亡的尴尬境地。唯有在法学教育精英化的导向下,把握好实践技能培养的阶段性特征,突破法学基础理论课程与实践性课程观念上的鸿沟,将实践技能尤其是法律思维的训练融入每一堂法学课程之中,法学本科实践性课程才能拓展出一片生存空间。 Law is temporal and instrumental, which determines that law education is practical. Restricted by educational myths, teaching cost, student number, evaluation mechanism, compulsory curriculum system and detached judicial examination etc, the practical legal courses are in the embarrassing situation of "to be or not to be" in the entire teaching system of law. It is proposed that practical law courses can sustain and fulfill training of practical skills, especially of legal thinking only when legal education is guided towards elitism, phased training, breakthrough of stereotyped teaching ideas.
