摘　　要： 能动司法必须以宪法和法律为依据,严格遵循司法规律,否则就可能偏离法治的正道。民事执行救助是人民法院践行能动司法理念的重要制度创新,具有宪法依据与政策基础,符合执行权的主动属性,对解决执行实践中的诸多问题具有一定的积极作用。构建民事执行救助制度,需要规范救助基金的来源与管理,明确执行救助的范围与对象、发放标准及发放程序,并建立相应的配套制度。 Dynamic justice must be based on the Constitution and laws,follow the judicial laws strictly,or may deviate from the rule of law of the right way.The relief of the civil procedudre is the innovation and practice of dynamic justice system,with a constitutional basis and the policy basis,in line with the implementation of the active property rights,effictive to solve many problems of implementation in practice.Construction of civilian implementation of the relief system,need to regulate the source of funds and management assistance,help clear the scope and object implementation,payment criteria and payment procedures,and establish the appropriate supporting systems.
