摘　　要： 诉讼时效的效力直接关系到该制度价值与目的的实现,对此各国民事法律有不同的规定。遵循民事立法的基本规律性,顺应我国民事司法改革的潮流,我国应该采抗辩权发生主义,由当事人承担举证责任,法院不得主动审查诉讼时效。 the effect of prescription of actions is directly related to the implementation of its value and aim.Different countries have their own legislation on the system.According to the rule of civil law and legal reform in the world,we should improve our limitation of actions system.
