摘　　要： 在深化改革背景下,基本养老金投资的本质乃是进一步发挥市场对于资源配置的优化作用,以实现基本养老金的保值增值。当前我国基本养老金的市场化投资与管理面临外部经济风险和内部监管风险的重叠,且在风险的法律分配上存在明显失衡,《基本养老保险基金投资管理办法》在对基本养老金投资风险的防控与分担方面仍存在诸多疏漏与不足。要全面应对多元化投资带来的市场风险,实现对基本养老金市场化运营风险的有效规制,还需在今后出台的实施细则与配套规定中进一步明确参保人在我国基本养老金信托投资法律结构下的受益人地位,同时健全基本养老金投资过程中的资金担保机制,并完善相应的监督机制,以促进基本养老金的可持续发展,更好地发挥基本养老保险制度的社会保障功能。 Under the background of deepening reformation, the essence of basic pension investment is to further the play of market optimization in resource allocation, so as to realize the maintenance and appreciation of basic pension. At present, the market-oriented investment and management of China＇s basic pension which are faced with the overlapping risks of external economic risks and internal regulatory risks, and there is an obvious imbalance in the legal distribution of risks, the existing ＂Measures for the Administration of Investment in Basic Pension Insurance Funds＂ still has many omissions and deficiencies in the prevention and control of basic pension investment risks. We should be fully prepared to deal with the market risks brought by diversified investment, and realize the effective regulation on the market-oriented operation risks of basic pension, it is necessary to clarify the beneficiary status of insured persons in the trust investment legal structure of basic pension in the future implementing rules and supporting provisions, at the same time improve the funds guarantee mechanism of basic pension in the investment process, and perfect the corresponding supervision mechanism, in order to promote the sustainable development of basic pension, and fully play to the social security function of basic pension insurance system.
