摘　　要： 欧盟司法制度的建设作为国际法律制度中的一个独特现象,一直受到国际法学界的特别关注。从欧共体的建立到欧洲联盟的崛起,欧盟司法制度经历了一系列变革,这一方面是因为欧洲一体化发展之内在需要,另一方面也与欧洲法院积极的司法实践密切相关,该变革体现于成员国的一系列条约修改活动。本文结合尼斯条约和欧盟宪法草案这两个法律文件,就欧盟司法制度的改革问题进行初步的探讨与分析。 There has been great academic concern upon the establishment of the EU judicial system, which enjoys uniqueness in the international law field. Evolving from EC to Union, EU judicial system has experienced a series of transformation, which is owing to the need of the construction of European integration as well as the radical practice of the European Court of Justice. This paper discusses the innovation of the EU judicial system under the Nice Treaty and Draft Treaty establishing Constitution for Europe.
