摘　　要： 推行强制医疗责任保险制度是缓和我国医患矛盾、形成良好医疗秩序的重要途径。通过对我国医疗责任保险发展历程和美国强制医疗保险经营现状的分析,探讨了我国实行强制医疗责任保险的法理依据和现实必要性,提出了建立"第三方管理+保费周期性调整+政府监管"型强制医疗责任保险模式、确立以强制医疗责任保险为支撑的无过错医疗责任制度以及建立联合承保组织等相关建议。 Compulsory medical liability insurance system is an important method to reduce medical risk and form a good medical order. Through the analysis of the current situation of medical liability insurance in China and the United States, the jurisprudential basis and practical necessity of compulsory medical liability insurance in china are discussed; Suggestion is put forward about the establishment of compul-sory medical liability insurance model of＂the third party management ＋ premium cyclical adjustment ＋ government supervision＂,about the establishment of no - fault medical liability system supported by compulsory medical liability insurance, and about the establishment of a joint underwriting organization.
