摘　　要： 现代司法理念与法律文明的发展赋予司法公正新的涵义--以实体与程序的和谐统一实现法律所追求的公平与正义。为实现司法公正,亟待构建制度保障体系,即以法律自治与司法独立为基础实现公正、以实体与程序的公开为形式促进公正、以司法效率的提高为目标保障公正,以合理的制度设计保障司法的真正意义上的"公平"与"正义"。 Modern judicial concepts and the development of the judicial civilization give the justice newmeaning--entity in harmony with procedure can realize the fairness and justice that the law pursues.It is imperative to establish the system that can guarantee the realization of justice. That is to say, justice is realized on the basis of the law autonomy and public procedure, and is guaranteed with the aim of making the entity and procedure public, and is guaranteed with the aim of raising the judicial efficiency so that the reasonable system design guarantees the real 'fairness' and 'justice' of the judicature.
