摘　　要： 《民法总则》的通过,表明我国在民法典的编纂工作进程中又迈出了坚实的一步,立法成果值得肯定。本文指出,《民法总则》在彰显人文主义、明确习惯的法律渊源地位、建立成年人监护、构建财产权的平等保护、确立期待权、妥善安排《民法总则》与《民法通则》的关系等方面有诸多亮点,同时《民法总则》在规定民法的适用规则、民法解释方法、国家的民事主体资格、非法人组织的登记制度等方面可能还存在一些缺憾。 The adoption of General Provisions of the Civil Law shows a solid step in the codification of civil code of China,and its achievement is worthy of credit.This article points out the merits of General Provisions of the Civil Law in various aspects,such as demonstrating humanism,confirming customary laws as the source of law,establishing guardianship for adults,constructing the equal protection for property right,protecting the expectation right,and combing the relationship between General Provisions of the Civil Law and General Principles of the Civil Law;at the same time,some deficiencies may remain in applicable rules and interpretation methods for the civil law,the qualification of civil subject of state,and the registration system for unincorporated organizations etc.
