摘　　要： 开发微信外挂软件销售这一新型案件的争点在于对该行为的精准评价定性。首先,虽然微信软件属于计算机信息系统,但在外挂未产生影响本体程序正常使用的场合,不符合"破坏"的要件解释,不构成破坏计算机信息系统罪。其次,开发外挂并销售的行为符合"复制发行"的实质解释,属于实质性包容型复制的新模式,构成侵犯著作权罪。再次,承认外挂软件属于非法出版物的场合,侵犯著作权罪与非法经营罪形成竞合,根据有权解释应以侵犯著作权罪定罪处罚。最后,以提供侵入、非法控制计算机信息系统的程序、工具罪归责虽然具有刑事政策考量的合理性,但仍有理论上进一步商榷辨析的余地。因此,对全国首例开发微信外挂软件销售案的刑法定性问题研究,具有理论与实务上重要类型化的探索意义。 The key of the new case of developing and selling WeChat plugin software is how to give the behavior accurate evaluation and qualitative analysis. First, although WeChat’ s plugin software belongs to the computer information system, it doesn） t affect the normal application of ontology program, so it does not conform to the interpretation of the “ destruction”requirement and it does not constitiite the crime of destroying computer information system. Next, the behavior of developselling plugin software is in line with the essence explanation of copying and issuing. It is a new mode of substantive inclusivereplication and constitutes the crime of infringing copyright. In that case, the plugin software belongs to illegal publications. Theinfringement of copyright and the crime of illegal operation form a concurrence. According to the right interpretaconvicted and punished for the crime of infringement of copyright. Last, it is reasonable invasion or illegally controlling computer information system from criminal policy consideration, but there is still room for furtherdiscussion in theory. The criminal qualitative research on the first case of developing and selling WeChat plugin software in Chinahas the groping significance of the important typification in theory and practice.
