摘　　要： 我国物权法对住宅小区车位权属及流转制度的规定过于原则,在车位的权属确定、流转方式、登记等方面存在着立法缺陷,无法满足司法实践需要,必须通过修改物权法或者制定实施细则对其做出明确规定。 The regulation of land expropriation on the ownership of parking lot and turning system in our country residence area is so simplified that there are a lot of lawmaking blemishes in produce power confirmation, turning way ,register, etc. tt can not satisfy judlcatory to practice a demand. We must confirm real right method through drawing up an ordinance or doing explicit rules.
