摘　　要： 在粤、港、澳经济融合的过程中,由于各自在当事人民事法律地位、物权、债权、婚姻、财产继承关系以及司法管辖等方面的法律制度的不同,使相互之间在法院判决的承认和执行以及证据的调取等方面存在着法律冲突问题。解决这一问题的主要方法是首先由广东在征得最高人民法院许可的情况下,由广东省高级人民法院与香港、澳门方面签订调查取证等问题的协议,再逐渐过渡到由内地和港澳达成相互承认法院判决和裁定等方面的协议,最终解决我国司法协助领域的法律冲突问题。 In the process of the economy mixing in Guangdong, Hong Kong and Macao, the difference between their legal systems of the party＇ s civil legal status, property right, debt right, marital relation, property inheritance relation and jurisdiction lead to the existence legal conflicts in the respects of admittance and execution of the judgment of the court and the adopt of evidence. The main methods to solve this problem are： first, with the permission of the Highest People＇ s Court, the Higher People＇ s Court of Guangdong Province sign agreements concerning the problems of investigation and evidence collection with Hong Kong and Macao; then, gradually transform to the agreement concerning mutual admittance of the judgment and decision of the court between Mainland, Hong Kong and Macao, and the final purpose is to solve the legal conflicts in the field of legal assistance of our country.
