摘　　要： 面对高校案件,法院对特别权力关系理论的运用抱着欲露还羞态度,他们的思路多少显得有些捉襟见肘。目前,由于立法的缺位,协调并指导法院办案的实际上是特别权力关系理论。虽然该理论解决了不少问题,但是由于标准的模糊及其趋势的式微,该理论难以适应发展的要求。从高校行政的行政行为模式参照入手,对于解决高校自主权与司法监督的问题,是一个可行路径。 Faced with the administrative cases in universities and colleges, the courts are embarrassed to apply the theory of special power relation. And they are short of ideas and measures. At present, due to absence of legislation, it is the theory of special power relation that is used to coordinate and guide the courts＇ practice. Although the theory has solved many problems, the theory is fuzzy in criterion and weakening, so it cannot meet the developing needs. It＇s a feasible way to consult the mode of administrative behaviors when dealing with the relationship between the school-running autonomy and judicial supervision.
