摘　　要： 我国关于社会化养老的相关规定主要分散在宪法、法律、行政法规、地方性法规及规范性文件之中,且立法较为单一地关注社会保险,忽视了社会力量的其他作用因素,顶层立法与地方立法之间亦存在衔接不足的问题,对于特殊老年人的权益保护也不够。未来应通过制定省级地方性法规的方式对社会化养老予以规范,丰富社会化养老的服务内容,引入社会力量参与服务,预留衔接法律的空间,注重保护特殊群体。 The relevant provisions of social endowment insurance in China mainly distributed in the Constitution,Laws, Administrative regulations,Local laws and regulations and normative documents.But legislation pays more attention to social insurance ,ignoring other factors of social forces ;there is also a lack of convergence between the top level legislation and local legislation,so the protection of the rights and interests of the elderly is not enough.In the future,it is necessary to regulate the social endowment by setting up provincial local laws and regulations,introduce social forces to participate in services ,space for the law of cohesion, focus on the protection of special groups.
