摘 要: 集体建设用地使用权流转反映了农村土地使用制度改革的客观要求,尤其是改革农村宅基地使用制度显得更加迫切。本课题在实地调查的基础上,提出流转政策对农村村民宅基地管理的影响主要表现在4个方面:"一户一宅,面积法定"的实施,空心村现象的消除,流动人员宅基地的管理,农村居民点的规划建设。针对这4个方面问题,本课题分别对流转政策实施前存在的问题,实施流转政策的作用及实施流转政策的建议措施都作了科学分析。在此基础上,本课题还在相关制度改革配套上提出5个方面的建议。 The circulation of the right to use the collective land for construction is the objective need to reform the rural Land use system, and it is more urgent to reform the systems of the rural land for house sites. Based on investigation, this project raises that the influence of the circulation policy upon the management of peasants' land for house sites mainly includes the four aspects: “to implement one-family-one- house and area-to-be-determined-by-law policy”; to eliminate the empty-countryside phenomena; to manage the flowing people's land for house sites; to plan and construct the county- sides' residences. In accordance with the four problems, this project analyses the problems existing before implementing the circulation policy separately and scientifically, the functions of the circulation policy and the suggestions and measures for implementing the circulation policy. On that basis, this project also puts forward five suggestions on reforming the relevant system.
