摘　　要： 2012年3月14日通过的《关于修改中华人民共和国刑事诉讼法的决定》增设了违法所得特别没收程序,这对加强打击腐败犯罪与恐怖活动犯罪有着十分重大的意义,但是由于违法所得特别没收程序的立法指导思想存在较大偏差,制度设计粗疏,缺陷在所难免,如诉讼架构严重失衡,悖离刑事诉讼法的基本原则,适用案件范围边界不清,生效没收裁定的直接撤销制度违反了程序正义等。为此,必须加强对违法所得特别没收程序的风险控制,首先必须实现立法指导思想从"重人轻物"向"人物并重"转轨的革命性变革,同时要注意遵循刑事诉讼法的基本原则;加强权利保障的力度,维持诉讼架构的平衡;建立货币化标准,严格限定违法所得没收特别程序适用的案件范围;维护生效没收裁定的权威性与安定性,废除直接撤销制度;加强对违法所得特别没收程序的检察监督。 On March 14, 2012 , special forfeiture proceeding of illegal proceeds has been added in＂The Decision of the Revision of Criminal Procedure Law of the People＇s Republic of China ＂ , which has a great significance in cracking down on the crime of corruption and terrorism .However, great deviation in the legislation guiding ideology of the illegal proceeds confisca- tion procedure, and careless system design make the procedure itself have many defects, such as serious imbalance in the struc- ture of litigation , deviating from the basic principles of criminal procedure law, the direct revocation system of effective confis- cate verdicts violates procedural justice, the boundary of applicable case of special confiscation of illegal proceeds is not clear, etc. Therefore, we need to strengthen the risk control on the illegal proceeds confiscation procedure. Foremost, we should im- plement the revolutionary transition of the legislation guiding ideology from ＂People is less important than treasure＂ to ＂People has the same importance with treasure＂. At the same time ,we need to abide by the basic principles of criminal procedural law; to trengthen the protection of the rights and maintain the balance of litigation structure; to establish monetization standards and strictly limit the illegal proceeds confiscated procedures applicable case scope; to maintain the authority and stability of the ef~ fective confiscate verdicts and abolish the direct revocation system ; to strengthen the procuratorial supervision on special confis- cation of illegal income.
