摘　　要： 死刑作为以剥夺人的生命为内容的极刑,目前尚不可能在我国境内废止适用,关注死刑犯的权利保护成为一个现实而紧迫的问题。生育权作为司法实践中绕不过的死刑犯权利之一,近年来在国内外引起广泛关注,确认并在条件许可下保障死刑犯的生育权应为趋势。结合我国当前的社会、经济以及法治的发展阶段,应当确认生育权为死刑犯享有,但该生育权受限制。 Since the death penalty won't be abolished in the recent future in our country,the rights of condemned criminal should be a question of reality.In order to fully ensure the procreative rights of condemned criminal,it is the tendency that the relevant laws and regulations should be improved in China.However,the realization of procreative rights is also subject to restriction.
