摘　　要： 春秋航空"黑名单"事件反映了航空公司不尊重消费者缔约选择权,不履行自己作为公共运输事业主体的强制缔约义务,是对契约自由的滥用。应该尽快制定《航空黑名单制度设置办法》,规定黑名单的设置条件,设置程序和期限,航空公司的黑名单建议权和国家民航总局的决定权,旅客的申诉权及程序,严重危害国家安全的恐怖分子黑名单的事先设置程序等。通过建立完善的航空黑名单制度,维护旅客的合法权益,保护国家的航空安全。 The ＂blacklist＂ event of Spring Airlines indicates that airline companies, without fulfilling the mandatory contracting obligations as a public transport carrier, do not respect consumers＂ rights on con- tracting, which is the abuse of Freedom of Contract. It is suggested that the Act of Aviation Blacklist should be promulgated as soon as possible, in which many aspects should be included such as the crite- ria, the procedures and the time limit of blacklist, the airline companies＂ right of advice of blacklist, the CAAC （Civil Aviation Administration of China）＇s right of decision, passengers＂ right of petition and ap- peal procedures, the prior setup procedures of blacklist to the terrorist who endanger national security, etc. By the establishment of impeccable aviation blacklist system, passengers＇ legal rights and nation＇s a- viation security can be protected.
