摘　　要： 辨认是一项常用的侦查措施,辨认结论也常常被法官直接采信而成为定案的重要根据,但在实践中往往过分夸大辨认结论的可靠性,而不去质疑其可靠性,这种拿来就用的做法其实是非常危险的。目前我国的辨认程序仍然不够完善,还难以真正保证辨认结论的证明力。本文针对辨认活动中存在的问题,用程序的眼光分析辨认程序, 从犯罪嫌疑人的诉讼权利、辨认笔录的制作和法官对辨认结论的采信等三个方面对辨认活动提出改进意见。 Identification is a common investigation measure. The decision of identification is also usually accepted directly by judge as a very important basis of adjudication. However, in practice, the credibility of identification is often exaggerated without any doubt. In the current situation, the procedure of identification in China is still not complete so that it is hard to assure the proof capability of identification. Aiming at the existing problems, the article analyzes identification from the aspect of procedure as well as makes reform advice from the following points： the procedure of making identification report, the acceptance of identification by judge and the procedural rights of the suspects.
