摘 要: 中国根据《华盛顿公约》第25(4)条所做声明构成ICSID对涉中国案管辖权的条件之一。即使在1998年后中国在双边投资条约中同意"全部投资争议可提交ICSID",ICSID对涉中国投资条约仲裁的管辖权依旧受到限制。基于"一国两制"的现实,中国在投资条约实践中应明确香港澳门居民不适用中国双边投资条约。 The notification rendered by China in 1990 pursuant to article 25 (4) of Washington Convention constitutes one of the elements required in order to have the jurisdiction of ICSID over cases relating to China. The notification has still limited the scope of disputes settlement of ICSID, even if China consents to "submit all investment disputes to ICSID" in bilateral investment treaties with other countries entered after 1998. In according to the fact of "one country, two systems", China should exclude explicitly the Chinese nationals resident in Hong Kong and Macao from the scope of BITs.
