摘　　要： 香港档案开放救济制度通过申诉专员与司法审查的制度安排和运作模式为信息申请人提供了较为完善和有力的权利保障。申诉专员独立、权威的审查能力和司法审查的确定性结论,为香港档案开放设置了成本最低和司法终局的救济标准。内地档案开放救济存在制度独立性、权威性不强和法院实质性审查无力等问题。在借鉴香港档案开放救济制度的基础上,可通过设立独立的信息委员会、确立行政复议前置规则等制度安排来完善内地档案开放救济制度。 The archive openness and relief systems in Hong Kong provide relatively consummate and effective protection on applicants＇ right through the ombudsman system and judicial review. The independence and authoritative investigation of ombudsman, as well as the certainty of judicial review, contribute to a final-ruling but lowest-cost relief standard for the archive openness in Hong Kong. However, the archives openness and relief systems in Chinese Mainland is absence of independence and authority, what＇s more, most of the courts are not effective enough in the depth investigation. When learning from Hong Kong, an independent committee of information disclosure and the priority of administrative reconsideration can be both established in order to satisfy the relevant relief standards.
