摘　　要： 有关暂予监外执行的现行立法存在以下缺陷:由于法律规定的原因,造成对监外执行罪犯监管不力;延长保外就医时对罪犯的考察方式具有任意性,延长期限的条件不够严格,导致保外就医期限恣意延长;收监条件粗疏,收监情形有疏漏;检察监督范围不够全面,缺少有力的监督措施以及监督缺乏权威性。 The concerning current lawmaking of temporary execution outside prison exists the following blemish： because of the reason of the law provision, giving rise to that the criminal being executed outside prision can not be well supervised; the manner of review to prolong the period is very random, the term of prolong period is not strict enough which produce arbitrariness when prolong the period of execution outside prison; the condition to throw into prison is inattentive and the situations of throwing criminal into prison contain careless omission; the scope of the supervise of procurator is not completely; be short of effective measures, the supervise of procurator has no authority.
