摘　　要： 一个行使法律赋予的国家职能的国家机关,其自身又很可能是这一职能的调整对象。认为检察机关拥有强大的诉讼监督权而以"谁来监督监督者"对检察机关诉讼监督职能正当性的质疑,是不能成立的。对检察机关权力的行使,并不存在监督制约缺位的问题。检察机关作为法律监督机关,其履行监督职责的方式不同于行政机关和审判机关,主要是启动相关程序,一般不是最终处分,因此没有必要由专门的机关对其进行监督。 An organ exerting the state power authorized by the law is likely to be the object of its own function as well. It is untenable to question the legitimacy of the procedural supervision by the procuratorial organ by reason of the hypothesis ＂who supervises the supervisor＂. The problem of absence of the surveillance and restriction does not exist in the exertion of procuratorial power. The procuratorial organ functions the legal supervisor, of which the main responsibility is not to make the final decision but to initiate the procedure ; therefore it is not necessary to be supervised by another special organ.
