摘 要: 借助《〈联合国气候变化框架公约〉京都议定书》创设的CDM机制,林业碳汇交易在我国得以发展,各地实践也取得了初步成效。但现行林业碳汇交易的交易标的物性质不明确、交易主体不确定、交易规则不清晰、交易制度位阶明显偏低。要实现林业碳汇交易的法制化,应当类型化碳汇权载体,确保林地产权无争议;吸纳公众型交易主体,增强碳汇交易市场活跃度;建立政府MRV流程,打通协同制度机制;提高立法位阶,制定省级地方性法规。 With the help of the CDM mechanism created by the Kyoto Protocol to the United Nations Framework Convention on climate change,forestry carbon sink trading has been developed in China,and preliminary results have been achieved. However,the legal nature of the subject matter of the current forestry carbon sequestration transaction is not clear,the transaction subject is uncertain,the transaction rules are not clear,and the level of the transaction system is obviously low. In order to realize the institutionalization and legalization of forestry carbon sequestration transaction,the carrier of carbon sequestration right should be typed to ensure that there is no dispute over forest land property rights;Attract public trading entities and enhance the activity of carbon sink trading market;Establishing the government MRV process and opening up the collaborative institutional mechanism;Improving the legislative level and formulate provincial local regulations.
