摘　　要： 我国已经步入老龄化社会,老年人口日益增加。老年人的精神权益保障和子女的精神赡养义务被提到议事日程。尽管家庭赡养是养老的最佳模式,成年子女应当承担对父母精神赡养的法定义务。为了强化成年子女的精神赡养义务和责任,应当完善立法,明确子女违反精神赡养的法定义务应当承担的法律责任。在一定程度上,政府应当减轻成年子女对父母物质赡养的负担和压力,积极承担保障老年人精神权益的国家责任。 With China having entered the aging society, the elderly population is increasing. Protection of the Rights and Interests of the Spirit of the elderly and the obligations of the spiritual support of the child are on the agenda. Family maintenance is the best retirement mode, adult children should bear the legal obligations of the spiritual support of parents. In order to strengthen the spiritual support obligations and responsibilities of the adult children, it should be the improvement of legislation, clearly defined legal responsibility that their children shall bear because of violating the spiritual support obligations. To some extent, the govern- ment should reduce the burden and pressure of the adult children to support parental materially and positively commit to the state re- sponsibility to protect the rights and interests of the elderly spirit.
