摘　　要： 当代家庭主要承载生育功能和情感功能。家庭成员之间以血缘为纽带,其权利与义务关系主要是根据血缘亲情而不是政治要求而建构,涉及一系列伦理价值判断。2001年《婚姻法》仅规定离婚后未与子女共同生活一方父或母有探望权,却忽略了孙子女、外孙子女与祖父母、外祖父母之间亲情联系的伦理需要。只有法律明确规定祖父母、外祖父母作为探望权的权利主体和义务主体,才更符合探望权的伦理价值取向。 Modern families mainly burden reproductive function and emotional function.The members of the family is connected with each other with blood;their rights and duties are mainly constructed according to the blood and emotion and not political reasons;the judgment of those rights and duties involves a series of ethic evaluation.Marriage Law adopted in 2001 stipulated that only the father or mother who has not live together with the child(ren) has visitation right;the law ignores the ethic needs between the grandchild(ren) and their grandparents.The author holds that the law should clearly stipulate that the grandparents are the subject of visitation right and such a stipulation is in accordance with ethic values.
