摘　　要： 在我国,"同妻"是一个数量庞大且与日递增的隐秘社会群体,在婚姻家庭关系中她们的身心健康权普遍性地遭受到不同程度侵害,配偶权更是得不到保障。在既有制度框架内"同妻"无论是解除还是撤销婚姻关系,均存在制度性障碍。《婚姻法》不应忽视"同妻"这类特殊群体的权利保障诉求,未来《婚姻法》修订时应当通过将"性取向冲突"纳入认定夫妻"感情已破裂"的法定情形之中、将"性取向欺诈"纳入可撤销婚姻适用条件之中、重新界定"有配偶者与他人同居"的概念外延以及完善相关举证责任制度等方法与手段确保"同妻"群体生活在《婚姻法》的光辉之下。 In China,gays＂ wives group is big and is increasing daily as a concealed social group, and the physical and mental health fights of gays＂ wives are infringed upon to varying degrees in the marital and familial relationship; the spouse rights of the gays＂ wives cannot possess protection.In the existing institutional framework there are institutional obstacles for the gays＂ wives to dissolve or revoke the marital relationship.The marriage law should not ignore the gays＂ appeal to right protection as a special group ;in the future revision of the marriage law the conflict of sexual orientation should taken as the circumstance under which the incompatibility should be considered ; the fraud of sexual orientation should be a reason to dissolve the marital relationship ; the ex- tension of the concept＂ cohabitation of a married person with a third party ＂ should be redefined and the refinement of the methods and means of the system of burden of proof should be ensured to guarantee the group of the gays＂ wives live under the sunlight of the marriage law.
