摘　　要： "清朗"行动的开展引发了关于社交网络账户法律属性的探讨,但我国《民法典》缺乏对社交网络账户的明确规定。霍菲尔德的权利分析理论表明,社交网络账户实际上是一种双务合同关系。用户权利的来源路径也说明了其本身并非物权,不具有对世排他性。因此,社交网络账户在转让、继承、救济等方面的规则适用,均应遵循合同之债的思路。 “Qinglang”action has triggered a discussion on the legal attributes of social network accounts,but there is no clear description or provisions of social network account in China’s Civil Code.By the deconstruction of the legal relationship of online community account through Hoffield’s theory,it can be found that social network account is bilateral essentially.The source path of user rights shows that it is not a real right which should be exclusive as well.Therefore,the rules of online community account in terms of transfer,inheritance and relief should apply to the idea of Contract Law.
