摘 要: 裁量基准作为行政自制的利器,旨在实现行政法规范的具体化,防止行政裁量权的滥用。作为解释性行政规则的裁量基准,其性质并不是法,但对行政机关与公务员具有拘束力,可作为行政执法的依据。为了保障个案正义之实现,行政执法者仍然可以根据具体情况依法超越裁量基准之限界。 The discretion standard as a tool for self-administration aims to make administrative law norms specific,and to prevent the abuse of administrative discretion.As a discretionary basis for explanatory administrative rules,its nature is not a law.However,for administrative authorities and the civil service it has binding function and can be used as a basis for administrative law enforcement.In order to guarantee the realization of justice cases,administrative law enforcement can still depend on the circumstances beyond the discretion of the base of the scope of the law.
