摘 要: 作为非正式法源的食品安全标准,具有明确的法律授权,制定过程与公告程序严密,对生产企业具有强制约束力,可以作为行政执法的依据,但从名称与形式上看仍然不能列为"法"之范畴。法院在审理过程中应尊重食品安全标准的专业性与科学性,赋予其实质的适用效力。 Informal law sources for food safety standard have clear and definite law authorizing,strict setting-up process and announcement procedure.They have strong constraint force for manufacturing enterprises and can serve as the basis for administrative law.However,in terms of the name and the form,they can not be categorized as 'law'.The court should show respects to the speciality and scientificalness of food safety standard,giving them real applicable effects.
