摘　　要： 中国传统司法活动中的思维方式,最本质的特征就是基于对和谐、无讼的理想追求,强调实质正义和息事宁人,虽然在某种程度上牺牲了法律的形式正义,但此种思维方式却也造就了泱泱人口的农业大国和谐而宁静的生活,并且此种思维方式在现代司法实践中仍大量存在,并对和谐社会的构建起着维护作用。因此,借鉴中西方实质正义与形式正义的思维方式,使中国传统的司法思维模式进行现代转化是完善我国司法制度,增强我国司法的正义与活力的必然选择。 The way of thinking of Chinese traditional judicatory activity,whose best entitative character is based on the pursuing a idea of harmonious and non-lawsuit,emphasizing essential justice and making concessions to avoid trouble,brings up a agriculture nation with vast of population and a harmonious peaceful life.Though the form of justice of law is neglected in a way,besides this way of thinking still abounds in modern judicatory practice,it is sticking up for the construction of the harmonious society.So using both the way of thinking of essential justice from China and the way of thinking of formal justice from the western for reference, making the modern transformation of the way of Chinese judicatory traditional thinking is the inevitable choice to consummate the iudiciarv and strengthen judicatory justice and energy in our country.
