摘 要: 作为义务教育的一种新动向,在家上学具有一定的伦理正当性和现实合理性,但它却是违法行为。在家上学"合理不合法"的现实窘境,已然对教育管理秩序造成一定程度的冲击,也亟待中国教育法治对其能否合法化做出适时回应。当前,支持和反对在家上学合法化的呼声并存。在家上学合法化的关键在于协调父母教育权与国家教育权、父母教育权与儿童受教育权、父母教育自由与政府监管规制之间的责权关系,即实现"三个协调"。而只有同时做到"家国协调"、"亲子协调"和"官民协调",在家上学的正当性才能彰显,科学性方能提升,可行性才能强化。也唯有此,在家上学方可合法化。 As a new development of compulsory education, home schooling has ethical justification and practical rationality. However, it is illegal. The real dilemma of home schooling "no reasonable legal", not only impact on order of educational management, but also need to make a timely response to it. Currently, for and against the legalization of home schooling coexist. The key to legalize home schooling is that the responsibility and authority to coordinate the relationship between parents' right to education and the right to national education, parent education and children's rights to education, parent freedom of education and government regulation. In other words, achieve "Three Coordina- tion". Only to achieve both "home-country coordination", "family harmonization" and "officials and the public coordi- nation ", the legitimacy of home schooling can reveal, scientific can ascend and feasibility to strengthen. And only this, home schooling should be legalized.
