摘　　要： 文章解析按揭的涵义 ,分析按揭的法律性质 ,比较按揭和让与担保的主要区别 ,探讨按揭的法律定位 ,并提出 :我国在立法中宜将按揭和让与担保两种制度进行归整 ,只使用让与担保一个名称 ,而将按揭的特殊之处以特别条文规定 ,以防止两种制度的交叉、重叠。 The paper tries to discusst he meaning of mortgage, analyzes its legal nature, and compare mortgage and conveyance guarantee, so as to find the legal orientation of mortgage. The author’s suggestions for the legislation of mortgage on the Mainland of China are as follows: to avoid overlaps between mortgage and conveyance guarantee and integrate them as one term “ conveyance guarantee”. As for the particularities of mortgage, they can be established in the form of special articles.
