摘　　要： 我国的纪检监察制度历经改革,其功能定位日臻完善。合署办公的纪委监察机关在反腐败斗争中处于领导组织协调的地位,并专门负责职务犯罪案件的调查。由于纪委监察机关位高权重、调查措施丰富强大、监督范围广泛,因而极易影响检察机关和审判机关对职务犯罪案件的依法独立审查和审判。为此,在纪检监察制度改革的背景下,应当进一步明确监察调查与检察审查之间的配合与制约关系,以"以审判为中心"的理念指引和规范监察调查,遵循司法规律和特点设定纪检监察机关监督检察官、法官的边界,以充分保障检察权审判权的依法独立行使。 The Chinese discipline inspection and supervision system had undergone reform and its function is increasingly comprehensive and positive.Discipline inspection and supervision combine to play a role of leadership organization and coordination in the fight against corruption,a main task of the Communist Party of China in the new era.The Chinese CPC discipline inspection and supervision organs are characterized with high political status,rich probe means and extensive influence on prosecutorial power and trial power while combating officialdom crimes.It is argued that the notion of"trial-centeredness"should serve as a guide for the relationship between discipline inspection and supervision organs and justice so that the independent legal implementation of prosecutorial power and trial power can be guaranteed.
