摘　　要： 中国作为第一人口大国,粮食安全有着根本的政治经济战略意义。应当认真定位粮食市场的＂决定性地位＂,推进全面依法治粮,通过＂从监管到治理＂的市场转型实行监管理念革新,通过＂全过程＂监管促进监管流程再造。必须制定《粮食法》,从基本法律层面规范粮食市场监管问题,通过市场准入监管、市场运行监管和市场退出监管,把粮食市场监管规范于《粮食法》的法治框架中,真正保障国家粮食安全。 Grain security is of fundamental and strategic significance in both political to China,one of the most populous countries.The decisive role which the grain market is and economic terms expected to play by the rule of law is to come true in the market whose mode of management is shifting from regulating to gover- ning.To achieve market regulation,it is necessary to promote access, market operation and market exit. Only when the grain the legislation, based on the Grain Act, of market market is governed under the legal framework of the Grain Act can it safeguard the state grain security.
