摘　　要： 经济法法定权利体系存在完整性、系统性的缺失问题。经济法权利研究的重心应实现由＂法定权利＂向＂应有权利＂的转变。以＂应有权利→法定权利＂为研究路径,考察在财富的创造、实现、消费过程中社会主体意识的法权要求,为维护社会主体的发展权益提供正确方向,并为促进经济发展方式转变的经济法权利体系提供法理基础。 The problem which the economic legal right system lack integrity and systematicness made the center of economic right research changed the ＂legal right＂ to the ＂ex debito justitiae＂.Only on the ＂ex debito justitiae＂ to the ＂legal right＂ approach,we can safeguard the right orientation of the social develop benefit,by examining the wealth creation,implementation,consumer consciousness during the legal rights of social requirements.It also provides the legal theory basis of economic law which can help improve the economic transform way of the economic legal system.
