摘　　要： 改革开放四十年,广东环境法治建设取得了令人瞩目的成绩,但也存在一定的理念指导与法治实践问题。以广东环境法治四十年作为分析样本,回顾了环境法治建设所取得的立法与司法成就,外生困境存在"环境法律完备论"与内生困境存在"社会系统建构要素"的认知。在粤港澳大湾区合作共赢的时代背景下,广东环境法治应该按照综合生态系统管理的要求进行理念更新。同时,环境法治还需要完成从"污染防治型"向"生态预防型"法律制度谱系的实践转向,最终实现广东环境法治的"再升级"。 In the past four decades of reform and opening up, the construction of the environmental rule of law in Guangdong province has made remarkable achievements, but there are some problems concerning the theoretical guidance and the practice of the rule of law. This paper takes Guangdong’s environmental rule of law in the past 40 years as a sample, reviews the legislative and judicial achievements of the construction of the environmental rule of law in Guangdong province and analyzes the endogenous and exogenous dilemma of the environmental rule of law in Guangdong and its causes. By emphasizing on the cooperation and win-win situation in Guangdong, Hong Kong and Macao Greater Bay Area, we hold that Guangdong environmental rule of law should be updated in accordance with the requirements of integrated ecosystem management. At the same time, the environmental rule of law also needs to change from the "pollution prevention type" to the "ecological prevention type" legal system pedigree and finally realize the re-upgrading of the environmental rule of law in Guangdong province.
