摘　　要： 我国学位授予可视为一种行政确认行为,是一种授益性行政行为;而学位撤销并非授予的延伸,而是一种行政救济手段。学位撤销的标准参照学位授予的标准可分为学术标准和非学术标准,但是应该更严苛。撤销该授益性行政行为受到时间、程序等因素限制,即学术事项无时间限制,而非学术事项则只限于事前撤销;学位撤销的程序遵循正当程序而非法定程序原则,包括启动程序、告知程序和听取意见程序。 Degree award in China can be regarded as an administrative confirmation act and a beneficial administrative act,while degree revocation is not an extension of award,but an administrative remedy.The standard of degree revocation can be divided into academic standard and non-academic standard according to the standard of degree award,but it should be more stringent.The revocation of degree is limited by time,procedure and so on,i.e.there is no time limit for academic matters,while non-academic matters are only revoked beforehand.The procedure follows the principle of due process rather than legal procedure,including the procedure of starting,informing and hearing.
