摘　　要： 公开募捐制度是关涉现代公益慈善体系建设的一项关键制度.《中华人民共和国慈善法》正式确立了公开募捐资格行政许可与募捐方案备案相结合的管理模式.这一制度的实施将对公益慈善生 态带来何种影响,这是慈善法正式实施后特别值得关注的问题.本文 以中国最早开展募捐制度改革和公募权开放的广州市为案例,重点分析了公募开放在破除“公募垄断”、“官办”慈善机构转型、社会组织资源结构变化以及慈善监管体系构建过程中的作用和影响,并有针对性地提出推动公开募捐制度有效实施的对策和建议. Public fundraising system is a key element in establishingmodern philanthropy system. Charity Law of the Peopled Republic of Chinaofficially builds up a management mode, combing administrative licensing ofpublic fundraising qualification and fundraising plan record. After the Charity Law takes effect, a problem worthy of paying close attention to is how this management mode will affect philanthropic ecology. Taking the practices of Guangzhou, the earliest explorer in fundraising system reform and opening of public fundraising qualification, as example, this paper analyzes the influence the opening of public fundraising qualification exerts on breaking public fund-raising monopoly, reform on government-based philanthropic organizations, resource structure change of non-profit organizations and philanthropic super-vision system construction. Accordingly, countermeasures and suggestions are proposed to effectively promote the implementation of public fundraising.
