摘　　要： 监察留置措施是我国监察体制改革中的重要内容,也是《中华人民共和国监察法》规定的12项调查措施中唯一限制被调查人人身自由的调查措施。通过对监察留置执行场所现状的考察,从保障人权、权力制衡和规范监察机关调查行为的角度来看,监察留置执行场所在实践过程中存在场所不统一、"同体监督"、未将两种类型的被调查人分别留置、配套措施不完善等问题。在遵循中立性、安全性及区别对待原则下,建立统一、规范的留置所并划归司法行政机关管理;将两种类型的被调查人分别留置、分别管理;对相关配套措施进行完善;依法规范监察机关的调查行为,保护被调查人的权益。 The supervisory detention is an important measure of the supervisory system reform in China,and also the only coercive measure that restricts personal liberty among the 12 investigative measures stipulated in the Supervision Law.The place to supervise detention is examined from the perspective of human rights,power balance,and investigation codes of the supervisory authorities.There are several problems such as inconsistent places to supervise detention in practice,inner supervision,failure to detain separately and lack of supporting measures.In this regard,it is suggested to follow the principles of neutrality,security,and differential treatment.The place to supervise detention should be unified and standardized under the administration of the judicial administrative authorities.Detention of the investigated persons should be separate,and related supporting measures should be improved.The investigation codes of the supervisory authorities should align with the law,and protect the rights and interests of the investigated persons.
