摘　　要： 知识产权侵权损害赔偿计算是法律上的重大难题,在知识产权损害赔偿数额计算与知识产权市场价值之间建立关联,不啻为一种法律创新思路。蓬勃兴起的资产评估法律,为无形资产价值评估与损害计算提供技术资源,美国法院在专利、著作权和商标侵权损害赔偿计算中不断尝试运用,取得效果。鉴于此,可结合我国法律与司法实践,提出资产评估技术在我国知识产权侵权损害赔偿中的具体适用理论。 It is always a big legal controversy as to the calculation of IP tort damages. Establishingthe relevance between IP damages and IP market value,maybe it is a good solution for calculation. The increasing development of appraisal law,has continually provided important resources for the valuation of intangible assets and IP damages calculation. American courts have been making progressesin the past years after trying to bring in valuation methods in patent,copyright and trade mark cases. For the perspective of legislation and practices in China,it is a valuable tendency to introduce appraisal methods into IP tort damages calculation.
