摘　　要： 在考察撤案制度及运行问题之后,笔者提出了我国制度完善的初步思路:应更新终止刑事案件与刑事追究的有关理念,加强撤案程序中的人权保障因素及恢复性,增加撤案申诉、撤案监督及司法审查程序,推进撤案程序的合理化、规范化、公开化与制度化. After a survey of the system of case withdrawing and its operation in China, the author puts forwand some suggestions for perfecting the system: the renovation of the idea, more mechanism for human rights protection, more channels for petition against the withdrawing and for judicial supervising.
