摘　　要： 现代刑法理论是在对刑法发展史上主、客观主义刑法理论扬弃的基础上逐渐形成和发展起来的,本文系统分析论证了刑法史上第一个理论形态——客观主义刑法理论产生的背景及其内涵,无疑对进一步全面正确地把握现代刑法理论的根基,具有重要参考价值. Modern theory of criminal law is based on the objectivism and subjectivism in the history of criminal law, the article makes a systematic study of the historical background and connotation of the first theoretical form (the objectivism) in theoretical history in criminal law,it's of great value for us to master foundation of modern criminal law'theory.
