摘　　要： 一度影响全国的“齐二药”假药案，目前已经尘埃落定，对于该案定性存在严重分歧，通过深入细致的法理分析，文章认为该案应该定性为过失以危险方法危害公共安全罪。该案认定分歧的厘清和准确定性将对未来司法实践中类似案件具有指导作用。 Based on the different opinions about the crime judgment in the ＂Qieryao＂ criminal case and with the detailed legal analysis, the case should be judged as negligent crime of endangering public security through dangerous ways and means. The full analysis about the difference and a correct judgment can be a sample to direct future similar case in judicial practice.
