摘　　要： 近年来,跨界污染问题的加剧推动了跨界污染治理中政府合作的实践进程。为保障政府合作能够稳定有效地进行下去,必须将这种合作行为纳入法治的轨道,使其受到法律的规制。当前跨界污染治理中政府合作的法律规制包括硬法规制与软法规制两种模式。这两种模式在各具优势的同时,也表现出一定的不足。为实现优势互补,应构建起硬法与软法有机融合的混合规制模式,以增强法律规制的效果,达到预期的目标。 Recent years has witnessed the progress of governmental cooperation driven by the aggravation of trans-boundary pollution. In order to guarantee its substantial development,this governmental cooperation should be bounded and restricted by law. The legal regulation in governmental cooperation in terms of the governance of trans- boundary pollution includes the patterns of hard law regulation and soft law regulation. These two patterns have their respective advantages as well as their own weak points. Therefore,a mixed regulatory pattern,which is organically combined by both hard law regulation pattern and soft law regulation pattern,should be constructed so as to make their respective advantages complimentary to each other,to enforce the effect of legal regulation,and to reach the expected objective.
