摘 要: 地方公共利益的存在与博弈催生了跨界污染治理中的生态补偿。跨界污染治理中的生态补偿是克服跨界污染及其治理外部性的基本途径和持续推进跨界污染治理的重要保障,应当遵循公平负担、损益相当、法定补偿与协定补偿相结合的原则。近年来,我国跨界污染治理中的生态补偿得到了较快的发展,但它存在的不足亦是显然易见的,如在跨界污染治理中,生态补偿多数停留于应然状态、生态补偿的适用存在局限、生态补偿的标准缺失、生态补偿的方式单一等。因此,必须立足于法律完善我国生态补偿的顶层制度设计,拓宽生态补偿的适用范围和实践领域,合理构建生态补偿的标准,充实和丰富生态补偿的方式,以进一步推动跨界污染治理中生态补偿的落实和发展。 The issue of public interest generates ecological compensation in the governance of transboundary pollution. The ecological compensation in governance of transboundary pollution is an important guarantee in pro- pelling the governance of transboundary pollution. The guiding principles would be an organic combination of "fair shouldering, profit & loss balancing~ legal compensation and protocol compensation ". Recent years have wit- nessed the fast development in the ecological compensation in the governance of transboundary pollution. Neverthe- less, the arising problems cannot be neglected. For instance, the application of ecological compensation is limited and monotonic, while still staying in the status of discussion and missing the standardization of the ecological com- pensation. Therefore, the system of ecological compensation should be improved from the top by law - making. Moreover, it is also important to broadening the application and practice of ecological compensation, constructing the standardization of ecological compensation, enriching the approaches of ecological compensation, in order to improve the practice and development of ecological compensation in the governance of transboundary pollution.
